General Information on Service of Applications and Interlocutory Applications (“Application(s)”) Under the Building Maintenance and Strata Management Act
| (1) |
Where the Applicant/ Respondent is not a management corporation or subsidiary management corporation
| (i) |
|
Where the Applicant/ Respondent, as the case may be, is not a management corporation or subsidiary management corporation the applicant shall serve the Application:-
| a) |
|
by post or by facsimile transmission to the Applicant’s/Respondent’s address of service; |
| b) |
|
by leaving it at his address for service; or |
| c) |
|
by affixing the Interlocutory Application on the front door of the Applicant’s /Respondent’s lot at the development / condominium concerned. |

| (ii) |
|
The address for service for parties other than a management corporation or subsidiary management corporation shall be: -
| a) |
|
in the case of an occupier of a lot, the address for service shall be the address of the lot; and |
| b) |
|
where an address for service of notices is recorded in the address so recorded in the strata roll the address so recorded. |

|
| (2) |
Where the Applicant/ Respondent is a management corporation or subsidiary management corporation
Where the Applicant/ Respondent, as the case may be, is a management corporation or subsidiary management corporation the Application shall be served leaving it with the chairperson or secretary of the management corporation subsidiary management corporation or of the council or with any member of the council thereof. |

| (3) |
Effect of modes of Service and Proof of Service
Where the Application is:
| (i) |
|
sent by facsimile transmission, proof of service shall be given by producing the original acknowledgment by electronic or other means to the effect that the notice or document has been received at the address for service; |
| (ii) |
|
sent by pre-paid registered post, proof of service shall be given by producing the original certificate of posting from the postal authorities; |
| (iii) |
|
delivered to or affixed on the front door of any lot, proof of service shall be given by way of Affidavit of Service (see form below); |
| (iv) |
|
by ordinary post- proof of service shall be given by way of Affidavit of Service (see form below); |
| (v) |
|
served on the management corporation or subsidiary management corporation under paragraph (2) above, proof of service shall be given by way of Affidavit of Service (see form below). |

| (4) |
Applicant shall inform the Board on mode of service of application and file proof of service to the Board
The applicant of the Application or Interlocutory Application as the case may be, shall file proof of service to the Board at least seven (7) days prior to the date fixed or to be fixed, for the first attendance before the Registrar, for the first mediation of the Application before the Board, or for hearing of the Interlocutory Application, as the case may be. |
